Mondolibrary License Agreement
DefinitionsIn this License Agreement “You” means a single:
(i) individual,
(ii) legal entity (United Nations agency, civil society organisation, etc.) or
(iii) agent acting on behalf of a single individual or entity.
Image(s) means:
(i) photograph(s),
(ii) illustration(s),
(iii) video(s) or
(iv) any other visual representation obtained via download from mondolibrary.
GrantMondofragilis network, who owns and operates the online image library “mondolibrary.net” grants you a worldwide, non-exclusive and non-transferable license to use the Image(s) only as provided in this License Agreement.
This license strictly prohibits the use of Image(s) in any commercial or promotional document.
Permitted UsesProvided that you do not intend the re-distribution or re-use of the Image(s), you may use the Image(s):
- in any electronic or print media, including editorial publications and fundraising materials;
- in any Internet, intranet, online or web-based media;
- in video, film, television broadcasts or theatrical exhibitions;
- in products including books, posters and calendars as long as these are not sold;
- for any other uses approved in writing by mondofragilis network.
Prohibited UsesYou are not allowed to
- use the Image(s) in any medium, document or message whose purpose it is to sell or promote a product or service;
- use the Image(s) in a false or fictional context;
- link
individuals, especially children and women, in any Image(s) to a specific story that identifies
them as being subjects of perpetrators of sexual violence, current or
former child soldiers, accused or convicted of crimes, or HIV-positive;
- sub-license, re-sell, distribute, rent, lend or offer the Image(s) as a gift;
- post or upload the Image(s) online in a downloadable format intended for multiple distribution;
- display the Image(s) in a format that enables it to be downloaded or distributed via mobile devices or file sharing arrangements;
- transfer, convey or assign rights to the Image(s);
- remove any copyright, trademark or watermark from any place where it appears on the Image(s);
- incorporate the Image(s), or any part of the Image(s), into a logo, trademark or service mark;
- use any Image(s) in a pornographic, defamatory, libellous immoral, obscene, fraudulent or otherwise illegal manner, whether directly or in context or juxtaposition with other materials.
Credit
Whenever you use the Image(s) in a way described under 'Permitted
Uses', you must include the following credit adjacent to the Image(s):
[Photographer's name]/mondolibrary.netRights-managed Image(s)All of the Images offered in mondolibrary are rights-managed. You are granted a license for a single use only. Using the same Image more than once is only permitted for translated pages on which the Image reappears. In case you would like to use the same Image for another purpose, you have to obtain a new license via mondolibrary.
CopyrightPursuant to the terms of this License Agreement, every Image is only licensed, not sold, to you. Accordingly, the Image(s) remain the sole and exclusive property of mondofragilis network or its licensors.
OwnershipThe Images are the property of mondofragilis network and/or its suppliers. You cannot acquire any right, title or interest to any Image.
PaymentYou agree to pay all Image(s) license fees. No licenses are granted until mondofragilis network receives full payment.
TaxesYou agree to pay and be solely responsible for any and all sales taxes, use taxes, value added taxes and duties imposed by any jurisdiction as a result of the license granted to you, or your use of the Image(s), pursuant to this License Agreement.
WarrantiesSince photographers and others who provide content for mondolibrary are responsible for correctly categorising and keywording their Image(s), mondofragilis network does not warrant the accuracy of such information.
JurisdictionThis License Agreement, its validity and effect, shall be solely interpreted, and governed by the laws of France. Any claims shall be brought solely in the Court of the préfecture d’Annecy and you expressly consent to the exclusive jurisdiction of the courts of France.
AcknowledgementYou acknowledge that you have read and understood this agreement. You agree to be bound by its terms and conditions.
Upon accepting the terms of this License Agreement, you further confirm that you are not and you are not acting on behalf of a profit entity.
